1. Acceptance of Terms
By accessing or using any of the services provided by ConvertSource (“Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to all the terms and conditions, you may not access or use our Service.
2. Description of Service
ConvertSource provides digital marketing services including, but not limited to, SEO, content marketing, PPC advertising, social media management, website analytics, and conversion optimization. The specifics of the services you receive will be detailed in a separate service agreement with you.
3. Eligibility
Use of the Service is available only to individuals who are at least 13 years old. By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of the terms and conditions set forth herein.
To access some features of the Service, you might need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself as prompted by the registration form. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.
  • Fees: The fees for our services will be outlined in your individual service agreement.
  • Payment: You agree to pay all fees in accordance with the payment terms stated in your agreement. Late payments may incur interest at the maximum rate permitted by law.
  • Changes in Fees: ConvertSource reserves the right to change its pricing at any time. We will provide you with notice of any changes before they come into effect.
All content included on the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Service, is the property of ConvertSource or its suppliers and protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, modify, or create derivative works from this content without our express written permission.
You agree not to use the Service to:
  • Violate any laws, regulations, or third-party rights.
  • Transmit or upload any viruses or other harmful code.
  • Interfere with or disrupt the integrity or performance of the Service.
ConvertSource may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
In no event shall ConvertSource, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Use of the Service is at your own risk. ConvertSource makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
ConvertSource reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
